But according to my testing the software shutdown that is done via GPIO 13 actually triggers the x708pwr.sh script with GPIO 5 and performs a safe shutdown before cutting off power.)

In this case my Pi do just NOTHING only if i attach a second drive to the board (no matter if there is something saved on the drive or not - just the hardware) the Pi will boot properly.
